Amber<p>So, I'm watching the Lawful Masses video about the Destiny 2 cheat developer lawsuit (Bungie v Elite Boss Tech), and they called for civil RICO on the cheat developers, but also CFAA on them, for *DOWNLOADING DESTINY 2* to create their cheat program. </p><p>So, the court case, was ended in default judgment due to the defendants not appearing, after being served. But I really hope this does not get argued in court, it would be really bad if you can be hit with CFAA for lawfully downloading a program, which you then find ways to change the data in it, that's.... that's bad yo.</p><p>The only good argument in the claim Bungie made, was contract violation, due to repeatedly violating the EULA/TOS/ect, by circumventing bans by creating new accounts.</p><p><a href="https://infosec.exchange/tags/hacking" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>hacking</span></a> <a href="https://infosec.exchange/tags/infosec" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>infosec</span></a> <a href="https://infosec.exchange/tags/destiny2" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>destiny2</span></a> <a href="https://infosec.exchange/tags/reverseengineering" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>reverseengineering</span></a> <a href="https://infosec.exchange/tags/lawsuit" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>lawsuit</span></a> <a href="https://infosec.exchange/tags/RICO" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>RICO</span></a> <a href="https://infosec.exchange/tags/CFAA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>CFAA</span></a></p>

Cory Doctorow<p>III. They were able to *hoard* the twiddling, using laws like the <a href="https://mamot.fr/tags/DMCA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DMCA</span></a>, <a href="https://mamot.fr/tags/CFAA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>CFAA</span></a>, <a href="https://mamot.fr/tags/Noncompetes" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Noncompetes</span></a>, <a href="https://mamot.fr/tags/TradeSecrecy" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>TradeSecrecy</span></a>, and other "<a href="https://mamot.fr/tags/IP" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>IP</span></a>" laws to control the conduct of their competitors, critics and customers:</p><p><a href="https://locusmag.com/2020/09/cory-doctorow-ip/" rel="nofollow noopener noreferrer" target="_blank"><span class="invisible">https://</span><span class="ellipsis">locusmag.com/2020/09/cory-doct</span><span class="invisible">orow-ip/</span></a></p><p>That last point is important: it's not just that big corporations twiddle us to death - it's that they have made it illegal for us to twiddle back. Adblock is possible on the web, but to ad-block your <a href="https://mamot.fr/tags/Iphone" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Iphone</span></a>, you must first jailbreak it, which is a crime.</p><p>23/</p>
Cory Doctorow<p>But now that Netflix has come for your family, don't even *think* about giving Netfix some of what it gave to the MPAA.</p><p>As a technical matter, it's not that hard to modify Netflix's app so that every stream you pull seems to come from your house, no matter where you are. But doing so requires reverse-engineering Netflix's app, and that would violate <a href="https://mamot.fr/tags/DMCA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>DMCA</span></a> <a href="https://mamot.fr/tags/Section1201" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Section1201</span></a>, <a href="https://mamot.fr/tags/CFAA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>CFAA</span></a>, and eleventy-seven other horrible laws. Netflix's lawyers would nuke you until the rubble bounced.</p><p>31/</p>
Tarah Wheeler 🖖♦️<p>Congratulations to <span class="h-card"><a href="https://mastodon.lawprofs.org/@riana" class="u-url mention" rel="nofollow noopener noreferrer" target="_blank">@<span>riana</span></a></span> Riana Pfeffercorn for this brilliant article "Shooting the Messenger: Remediation of Disclosed Vulnerabilities as CFAA “Loss."" It importantly covers the <a href="https://infosec.exchange/tags/abuse" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>abuse</span></a> of the <a href="https://infosec.exchange/tags/CFAA" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>CFAA</span></a> to silence <a href="https://infosec.exchange/tags/vulnerability" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>vulnerability</span></a> researchers due to the low (and arbitrary IMHO) loss threshold for a suit to be brought. </p><p>Here's the killer line: "The CFAA still lets litigious vendors “shoot the messenger” by suing over security research that did them no harm. Spending just $5,000 addressing a vulnerability is<br>sufficient to allow the vendor to sue the researcher who reported it, because such remediation costs qualify as “loss” even in courts that read that term narrowly." </p><p>Pfeffercorn proposes tightening the loss definitions &amp; calculus to remove this weapon from the hands of companies suing researchers in bad faith. </p><p>Also from the acknowledgements: "This article is dedicated to the memories of Peter Eckersley, Elliot Harmon, Dan Kaminsky, Dmitry Karshtedt, and Sherwin Siy." *snif* Someone's cutting onions in here. </p><p><a href="https://jolt.richmond.edu/files/2022/11/Pfefferkorn-Manuscript-Final.pdf" rel="nofollow noopener noreferrer" target="_blank"><span class="invisible">https://</span><span class="ellipsis">jolt.richmond.edu/files/2022/1</span><span class="invisible">1/Pfefferkorn-Manuscript-Final.pdf</span></a></p>
