The new details of the final hours of the occupation of Hamilton Hall on April 30 were among the key revelations of the 335-page report, which was written by a group within the senate, a #Columbia policymaking body that includes faculty members, students & administrators, with faculty in the majority. Judge Howell added she was particularly concerned about the success of the plaintiff’s likelihood of success, particularly because they had sued in their official capacities even though they had been removed.

#USIP sued the #Trump admin after members of #ElonMusk’s #DOGE effectively executed a physical takeover of USIP HQ earlier this week.

Throughout the hearing, Judge Howell repeatedly emphasized the appalling treatment of the people who worked at #USIP. But she ultimately said there are serious questions about USIP's structure that suggest #Trump may have authority to do what he did. She will expedite case.

Judge Howell said she is unclear whether the USIP is an executive branch agency, & has requested a briefing on the matter.

Judge Howell denied the #USIP TRO. She says she's "very offended by how #DOGE has operated" but the jurisprudence isn't clear enough about how it applies to this type of entity.

Howell is concerned about the likelihood of success because they've sued in their official capacity for personal relief.

Howell said it's undisputed that they were removed in violation of the statute, but the DC Circuit's Dellinger decision says they can't have irreparable harm.

#SCOTUS ruled in 1935 to uphold a #law that allows #FTC commissioners to be fired ONLY for good #cause, such as neglecting their duties. The ruling shields a number of #independent, bipartisan multi-member agencies from direct control by the #WhiteHouse.

The #DOJ is aiming to get these cases to #SCOTUS, where it’s betting that enough of the right-wing justices will agree to overturn the high court’s own #precedent on #independent agencies — encapsulated primarily in a 1936 case called Humphrey’s Executor — & axe the removal protections that keep leadership at such entities as the #NLRB or #MSPB insulated from political will or vindictiveness.

The startling admission came in response to a federal judge’s hypothetical.

“Could the President decide that he wasn’t going to appoint or allow to remain in office any female heads of agencies or any heads over 40 years old?” Judge Karen Henderson, a Reagan appointee on the DC Circuit Court of Appeals, asked Dpty Asst AG Eric McArthur Tues in proceedings over the fired board members of two #independent agencies.

The flights suggest the #Trump admin may be growing more brazen in its defiance of judicial restraint. The #US #Constitution established the #judiciary as a co-#equal & #independent branch of government.

Trump has sought to *push* [illegally expand] the boundaries of #ExecutivePower since taking office in Jan, cutting spending authorized by #Congress, dismantling #FederalAgencies & firing tens of thousands of #FederalWorkers.

On Friday, several #DOGE employees arrived at the #UnitedStates Institute of #Peace [#USIP], accompanied by 2 #FBI agents, according to Gonzo Gallegos, the institute's communications director. They left after a brief discussion about the institute's status.

The institute is not part of the federal #ExecutiveBranch, but is instead an #independent, #nonprofit agency that was established by #Congress in 1984.

The panel of 3 judges from the US Court of Appeals for the DC Circuit said the govt had met the “stringent requirements” for securing a stay while the court considers the #Trump admin’s appeal in the case.

The brief order had no noted dissents from the judges, who were appointed by presidents from both parties. It said a full opinion would be forthcoming.
