Green party claim Sentencing Council bill based on 'wilful
misunderstanding’ and will lead to more unjust punishments
The Green party has also criticised the governments decision to introduce
the sentencing guidelines (pre-sentence reports) bill. In a statement, the
Green MP Sian Berry said:

44 It has been chilling to witness the government pile pressure on an
independent body which has been nothing but clear about the importance of
these guidelines for passing effective sentences.

The new guidelines, which were publicly consulted on, would have helped create
safer sentencing for many women, parents, pregnant and young people, for
whom extreme custodial sentences can compound the harm that led to their
offending in the first place. This delay will condemn too many people to unjust
punishment while we wait for new plans.

Pre-sentencing reports offer judges information, they do not determine
sentences. Politicians’ wilful misunderstanding of these processes is dangerous
and will cause irrevocable harm for many if this bill is passed.

Government should have 'pushed back’ against 'two-tier justice’
claims, says Labour peer Shami Chakrabarti

The Labour peer Shami Chakrabarti told the World at One she thinks the
government should have “pushed back” at the Tory claims that the new
guidelines from the Sentencing Council amount to “two-tier justice”.
Chakrabarti, who was shadow attorney general when Jeremy Corbyn was
Labour leader and who before that head of Liberty, the campaign group, said
she thought Robert Jenrick, the shadow justice secretary, has misrepresented
what the guidelines were doing. They say judges should require pre-sentence
reports before offenders from certain groups, including ethnic minorities, get
sentenced. Chakrabarti said this was a response to evidence showing there is
structural discrimination against minorities in sentencing.

She said:

I certainly don’t think of that giving this kind of advice [a pre-sentence
report] amounts to two-tier justice, and I think the government should have
pushed back against that narrative...

I'm nervous that with Reform on the rise, and the Conservatives running scared
from Reform, the government is presented with this choice and with these
pressures, and it’s too easy to be drawn to the right on matters of rights,
freedoms and justice. I would urge caution on that.

And I would urge caution when it comes to interfering either with independent
judges or with a Sentencing Council that ought to be independent of
government.

Sarah Montague, the presenter, asked Chakrabarti to respond to an argument
made by the columnist Stephen Bush in the FT explaining why the
guidelines can be seen as unfair. Bush says:

44 If we think that pre-sentence reports result in judges making better decisions,
it’s not fair for some offenders to be the beneficiary of better decisions and for
others to not be.

Just as an illustration of that, 64 per cent of young offenders from “other”
ethnic groups are eligible for free school meals (compared with about a quarter
of the school-age population), while 63 per cent of young offenders from a
“Black” minority background are. It seems a fair assumption that not having
very much money is an aggravating factor for going on to commit a crime. So
why should the 52 per cent of young “white” offenders eligible for FSM not
automatically qualify for a pre-sentence report?

Chakrabarti said in an ideal world she would like every offender to have a
pre-sentence report. When it was put to her that this was not feasible, she
said a range of factors should decide whether resources should be spent on a
pre-sentence report. If the offender comes from a different background to the
sentencer, the sentencer should be more inclined to learn more about them
via a pre-sentence report, she said.

We are not our ancestors, we can choose not to continue their sins, build better worlds instead.
Our oppressors are pushing these conspiracy theories, let's be smarter, let's not let ourselves down.

I've written about this before, but White Guilt and White Shame are not productive.
At best, they are a nuisance to people of color in activist spaces. These feelings can
lead to poor mental health, driving usually Autistic or Moral OCD white people to
burn themselves out trying to martyr themselves atoning for the sings of their
ancestors. At its worst, these feelings can drive white people to over-correct into full
on fascism and conspiracy thinking. Unable to accept the negative feelings associated
with being the beneficiary of historic atrocities, white people construct a phantasm of
the evil Jews funding Black Lives Matter and putting Black History Month in schools
in order to destroy the white race (because there's no way Black people could have
ever self-organized apparently.)

Whiteness is a void that robs us of our cultures

Believe me when I tell you my desire for us to go out into the Stars and diversify is partly a reaction to the void of Whiteness, so when that Whiteness in the form of Elon Fucking Musk wants to steal all that from me, it is very personal.

In the alternative or left-leaning crowds, you see Neo-Pagans practicing a version of
Celtic or Norse paganism invented whole cloth from Roman-authored historical
accounts with no connection to anyone living in Ireland or Scandinavia and no
connection to any lineage of practice. You see Ashkenazi Jews who, while benefiting
entirely from white privilege, will insist that Jewish people are not white, and will
remind you of their Jewishness every chance they get. You see young white
progressive Jews who live by strict Orthodox halacha that bewilders their Reform
parents. Some of these practices, I think, are the same phenomena as the Nation of
Islam, or the invention of Kwanzaa, just situated at a different level of the social
hierarchy. People severed from their cultural heritage looking for something to
identify with. Assimilation into whiteness provides a beneficial relationship to power,
but identification with whiteness does not provide a cultural identity or meaningful
heritage.

There is much, much more to Irish culture than drunken violence you racists!

Trying To Not Be White

Sometimes, white people over-identify with a part of their ancestry in a way that
seems odd. Irish-Americans, who have nearly nothing in common with Irish people in
Ireland, will cosplay as leprechauns on St. Patrick's Day, despite that being an anti-
Irish caricature in the British Isles where anti-Irish sentiment actually matters. Italian-
Americans, who might not even know what part of Italy they're from, are obsessed
with Columbus Day. The Irish and Italians were once seen as not quite white, pseudo-
white, the lesser-whites, but not so much so in the 21st century, where assimilation has
consumed most distinguishing features of the "ethnic whites."

Fellow white people, it doesn't mean we are personally bad people, it's just that we've been raised to assume all of this is 'normal', when we can see from all the suffering and inequality, it ain't.

White is a Relationship to Power

Perhaps this is why in F. D. Signifier's film, the "white" people are not comfortable
identifying as Thai, Arab, Jewish, or Italian without also identifying as white, because
they recognize their place in a hierarchy, a place which white individuals do not
actually have the power to give up even if we want to. To be seen as white affords you
white privilege even when you're Arianna Grande or Rachel Dolezal cosplaying as
Black. White privilege also is the generational wealth and circumstance which set you
up for your current life. Even if you wish to disown whiteness, you must recognize
that whiteness set you up for more success in your youth.

America was the 'Land of Opportunity' for the downtrodden Europeans suffering under the rich, so we went to America and unloaded that grief on the Indigenous people we slaughtered and the African people we abducted to serve us.

let's not make these mistakes again if we do make it out into Space, we can choose Elon's path or Star Trek.
