The #NY State #Education Dept issued a defiant response to #Trump’s threats to pull federal #funding from #PublicSchools over #diversity, #equity & #inclusion programs, a remarkable departure from recent conciliatory approaches of other institutions. A day earlier, the federal govt issued a memo to education ofcls across the nation, telling them to confirm the elimination of all programs it argues *unfairly* promote #DEI.

A federal judge in Maryland Friday ordered the #Trump admin to take immediate steps to return a MD man who was deported to #ElSalvador’s #CECOT mega-prison by mistake, setting up another high-stakes clash between the WH & the courts.

"This was an illegal act," US Federal District Judge Paula Xinis told #DOJ lawyers at a federal court hearing in Greenbelt, MD about the deportation of #KilmarAbregoGarcia, who lived in the US legally & had a work permit.

Texas AG Ken Paxton Won't Face Federal Corruption Charges as He Gains Momentum for Likely Senate Run

The federal criminal investigation was the most serious legal threat the once-embattled Republican faced. With the probe now over, Paxton is gearing up to likely challenge U.S. Sen. John Cornyn in 2026.

An admin that is going to want the vote of #SCOTUS Chief Justice #JohnRoberts might do well to recall that Roberts spent years in private law practice.

One lawyer leading the anti-#Trump advocacy surmised that the #DOJ is “trying to play to #Trump, & #StephenMiller,” the deputy White House chief of staff. “It’s a very bad strategy,” the attorney added. “We’re by the day gaining more credibility with the Supreme Court by just not being crazy about court orders & judges.”

#Trump dispatches attys like so much legal cannon fodder, to defend the admin’s actions w/little or incorrect information about the underlying facts. It is grudging, if that, on compliance w/court orders, all but inviting judges to find the admin in #contempt of court. Add…Trump’s out-of-court behavior, which has included assailing a respected district-court judge as a “radical left lunatic,” calling for his impeachment, & going after #BigLaw w/blatantly #unconstitutional executive orders.

These stats don’t merely indicate that the #Trump admin is on the wrong side of the #law. They also reflect bad lawyering. The admin’s hyper-aggressive litigation strategy combines maximalist [abusive] assertions of the scope of #PresidentialPower w/the insistence that any potential intrusion on executive authority necessitates emergency relief. It is belligerent in tone, treating federal judges like junior associates at law firms, when not asserting that they are biased partisans.

These numbers are especially striking because the cases are at a preliminary stage, when the hurdles are high for those seeking to block an admin action.

With 6 emergency petitions challenging 4 different #Trump admin policies now before #SCOTUS, the coming days should provide a better sense of how Trump will fare there. The early indications are not good for the admin: the Court effectively rebuffed a request for emergency intervention involving #USAID, albeit by a vote of 5–4.

Remember when #Trump told people that they’d get tired of winning once he was in office? If you are a Trump Admin lawyer, it surely doesn’t feel that way. Based on the #litigation tracker compiled by #JustSecurity, the admin…has lost in 36 of 56 cases decided so far in the federal district courts & not yet subject to appellate rulings. It has lost in 10 of 15 cases that have been decided at the next level of review, the federal circuit courts of appeals.

The New Yorker · Has Trump’s Legal Strategy Backfired?By Ruth Marcus

#NorthCarolina's #Republican majority Court of Appeals sided w/the GOP candidate in a suit contesting last year's State #SupremeCourt #election.

The decision could result in ~64k ballots being thrown out, handing the election to the Republican instead of the Democratic Justice who won.

The case will likely be appealed.
